Jakarta, 27 April 2020. The Corruption Eradication Commission named two new suspects in the development of the alleged bribery case related to the project from the PUPR Office of Muara Enim Regency in 2019. The two suspects were AHB (Speaker of the Regional House of Representatives, Muara Enim Regency) and RS (Acting Head of the PUPR Office of Muara Enim Regency).

Suspect AHB has allegedly received Rp3,031 billion in the period between May and August 2019 from Robi Okta Fahlefi, an individual from the private sector. This gift was allegedly related to the commitment fee from Robi Okta Fahlefi for 16 work packages in the Muara Enim Regency.

The other suspect, RS, was alleged to have received Rp1,115 billion from the same private sector as Acting Head of the PUPR Office of Muara Enim Regency. In addition, he has also allegedly received 1 unit of Samsung Note 10 mobile phone that was given in the period between December 2018 and September 2019 in Citra Grand City Cluster Sommerset and RS’ house. This gift was allegedly related to the commitment fee for 16 work packages in the Muara Enim Regency.

The suspects allegedly violated Article 12 point a of Law Number 31 of 1999 on the Eradication of the Criminal Act of Corruption as amended by Law Number 20 of 2001 regarding the amendments to Law Number 31 of 1999 concerning the Eradication of Corruption in conjunction with Article 55 paragraph 1, 1st of the Indonesian Criminal Code (KUHP) in conjunction with Article 64 paragraph (1) of the Indonesian Criminal Code (KUHP) or Article 11 of Law Number 31 of 1999 on the Eradication of the Criminal Act of Corruption as amended by Law Number 20 of 2001 on the amendments to Law Number 31 of 1999 on the Eradication of the Criminal Act of Corruption in conjunction with Article 55 paragraph 1, 1st  of the Indonesian Criminal Code (KUHP) in conjunction with Article 64 paragraph (1) of the Indonesian Criminal Code (KUHP).

KPK arrested the two suspects on Sunday, 26 April in two separate places. KPK arrested RS at 07.00 WIB (Western Indonesian Time) at his private home in Citra Grand City Housing Complex, Palembang.

Then in parallel, the KPK arrested AHB at 08.30 WIB at his parents' house on Urip Sumoharjo Street, Palembang. After being arrested, the two suspects were then interrogated at the South Sumatra Regional Police Station. Next, the two suspects were dispatched to KPK's Red and White Building and arrived on Monday, 27 April 2020 at around 8:30 WIB.

This detainment was carried out because the two suspects have been called twice, namely on 17 April 2020 and 23 April 2020. However, they did not respond to the calls.

After the investigation, the suspects have been detained for 20 days from 27 April 2020 to 16 May 2020 in the KPK Detention Center Branch in the KPK Building Lot C1.

This case began with the arrest on 3 September 2018. At the time of the arrest, the KPK secured USD 35,000 and named 3 people as suspects, namely AYN (Muara Enim Regency Regent 2018-2019), EM (Head of Road Development and PPK in the PUPR Office of Muara Enim Regency) and Robi Okta Fahlefi (private sector).

At present, the trials of AYN and EM are still ongoing, whereas ROF has been convicted and sentenced by the panel of judges in the Palembang District Court with a 3-year prison sentence and a fine of Rp250 million to be substituted with 6 months in prison.

The Corruption Eradication Commission remains and will continue to be committed to taking action through the development of cases or other efforts in accordance with the law. The KPK is never tired of constantly reminding all state administrators to carry out their duties in accordance with applicable regulations and not to harm the Indonesian people. This is because in actuality, the state administrators are paid using public funds and should work to improve the prosperity of the people, not to serve certain personal or group interests.
