Jakarta, 7 February 2020. Corruption Eradication Commission (CEC) receives recent help of force in investigating allegation of bribery related to the procurement of airplane engine of PT. Garuda Indonesia. The support came from international society with the signing of Deferred Prosecution Agreement (DPA) between Serious Fraud Office (SFO) with Airbus SE.

Built upon this agreement, SFO is willing to postpone the legal action against Airbus SE. The condition is that Airbus SE must be willing to fully cooperate with law enforcement officers by admitting its actions, settling fines, and conducting reform and corporate governance program.

It is mentioned in DPA that Airbus SE will pay a fine of 991 million Euros to the Government of The United Kingdom. The amount is a part of global agreement of 3.6 billion Euros that will be paid by Airbus SE to the governments of The United Kingdom, France, and the United States.

DPA itself is a result of the investigation conducted by SFO to allegation of bribery given by Airbus SE to officials within 5 jurisdictions: Indonesia, Sri Lanka, Malaysia, Taiwan, and Ghana during 2011-2015. In Indonesia, the investigation conducted by SFO is in line with the investigation of Garuda case performed by CEC.

The Commission appreciated SFO and other law enforcers in The United Kingdom  for the agreement. Since the beginning of the investigation of allegation of bribery related to the procurement of airplane engine of PT. Garuda Indonesia, CEC has been working together with law enforcement authorities in several related countries, some of which are The United Kingdom SFO and Singapore CPIB.

CEC is confident that DPA will strengthen the evidences found during investigation and prosecution process of allegation of bribery related to the procurement of airplane engine of PT. Garuda Indonesia. It comes from the fact that there are descriptions of facts related bribery to officials of PT. Garuda Indonesia in the Approved Judgement and Statement of Facts documents which is an inseparable part of DPA.

Those facts are in line with facts discovered during the Garuda case handling by CEC. Currently, defendants Emirsyah Satar and Soetikno Sedarjo is undergoing trial while suspect HDS (Technical Director of PT. Garuda Indonesia (Persero) Tbk 2007-2012)) is still under investigation.
