Jakarta, 21 November 2019. The Corruption Eradication Commission (KPK) strives to return stolen state money of Rp4.58 trillion in the case of Bank Indonesia Liquidity Support (BLBI). In its legal consideration, KPK said that such a huge amount of money can be utilized to build infrastructures of education, health and other public facilities. But such herculean task requires support from various parties.

KPK has sent a letter dated 6 September 2019 to SES NCB-Interpol Indonesia to request red notices for SJN (holder of BDNI controlling shares) and ITN (private sector), suspect of corruption pertaining to the disbursement of the BLBI funds from the Indonesian Bank Restructuring Agency (IBRA).

The next step, based on the response from NCB Interpol Indonesia, is a coordination meeting with KPK and case hearing when necessary. The support from the National Police and NCB Interpol is crucial to handle the case that is estimated to inflict Rp4.58 losses on the state.

Moreover, following the acquittal verdict for convict Syarifuddin Arsyad Tumenggung, KPK’s prosecutors are considering the legal basis to file judicial review.

KPK has worked hard to bring suspects SJN and ITN to court. Prior to requesting the Red Notice, in September 2019, KPK had put them on the most wanted list. Previously, KPK had summoned both suspects twice, on 28 June and 19 July 2019 and both had not come.

KPK named SJN and ITN as suspects since 10 June 2019 for allegedly misrepresented Rp4.8 trillion loans for fish farmers as receivable. The misrepresentation is estimated to inflict state losses of Rp4.58 trillion. The Financial Due Diligence (FDD) and Legal Due Diligence (LDD) investigations found that the asset was a non-performing loan and the debt collection rights for the farmers only stood at Rp220 billion.

The alleged crime faced the charge of violating Article 2 (1) or Article 3 of Law No. 31/1999 that has been amended to Law No. 20/2001 on Corruption Crime Eradication juncto Article 55 (1)-1 of the Criminal Code.
